    I think it's the level of deceit, dishonesty and continued effort to destroy the democracy that this county was built on that makes the continued push from Trump and his team news worthy. Granted it's in a terrible way and for all the wrong reasons. Could we look away and pretend it wasn't happening yes, I'm not sure what the right answer is here. It's certainly not going away. I think the next thing to look at for in addition to the continued claims of the election being rigged and stolen from him is the pardons.

    It's not going to be a popular move, and bluntly, could actually be more problematic in the short term, but the right answer to ending this trainwreck is to charge him with sedition. He's been using his platform for the explicit purpose of inciting revolt with the intent of overthrowing the lawful authority of the duly elected government. That is sedition - almost textbook, even. Enough is enough.

    You can't charge a sitting president per DOJ guidelines but once he's out of office, SDNY is apparently ready to move forward prosecuting his case in NY State.

    Sort of. The DOJ has a binding policy saying so, but there's no real consensus on it legally.

    Basically...nobody's challenged it, therefore it's a standing policy, but there's not really an extant reason for a challenge to fail.

    Right, that's why they're guidelines and not policy. Semantics, but important context.

    Regardless, the biggest question we're going to be facing is what will come of prosecuting a former President after he's left office. We're about to find that out shortly after January with SDNY's case. Federally, I don't think Biden or his DOJ will want to spend much time prosecuting the former administration if for no other reason than the desire to move forward.

    I seriously doubt Biden will spend an ounce of effort to engage with Trump in any way, inclusive of whatever SDNY finds. He will shrug his shoulders and remain impartial because he feels that the role of the DOJ and the legal system is to be non-partisan.

    What's going to get really interesting is that SDNY, if they find them, can recommend federal charges.

Biden will be tarred with "going after" his predecessor by the ring-wing crowd who will see any prosecution of Trump as a "partisan witch hunt" a la the 'Russia Hoax' anyway, but whether the charges elevate to federal or not, an independent DOJ is key in keeping any prosecution of Trump on the up and up.

    It doesn't matter if it's a parking ticket or high treason. The MAGA crowd will view anything as revenge on Trump and an attack on conservatives by evil communist liberals hell bent on taking over America. It's why it's so disturbing to see so many GOP Senators kowtowing to what we're seeing right now. This isn't factual, it isn't normal, and it should not be a popular stance, but Trump really has a hold of this wing and the GOP views them as quite powerful.

    However, since that's the default position, the choice is ostensibly "cut the heads off the hydra" or "let the hydra win". Either way, you're getting angry, potentially violent conspiracy theorists; it's just a matter of whether we get them now or later.

    As we've talked about off the forum, the issue isn't actually the GOP party but the GOP base. It's whatever cross section of the 70+ million votes he earned we have to worry about by prosecuting Trump, not the party he leads. Marco Rubio can post all the smarmy tweets he wants crying about liberal overreach and witch-hunting. It's y'all Qaeda who we need to worry about taking to the streets, armed with military-style rifles and body armor because they're mad their golden calf lost.

    Exactly. I fully trust the FBI has their finger on the pulse of this matter, but that it's become worse under Trump because of his constant flame-fanning is worrisome. France, for example, is currently prosecuting it's former head of state, Nicolas Sarkozy, for corruption (first time since 1945 they've done so). The difference between he and Trump? There aren't millions of Sarkozy superfans driving around in modified off-road vehicles adorned with flags and tributes to him, armed to the teeth, threatening violent retaliation.
