San Jose Sharks forward Raffi Torres will have a hearing Monday to address his illegal check to the head of Anaheim Ducks forward Jakob Silfverberg, the NHL's Department of Player Safety announced Sunday.

Torres - a repeat offender suspended four times in total by the NHL - has decided against attending an in-person hearing.

The disciplinary committee is classifying the hit, which forced Silfverberg from the game, as an illegal check to the head, interference, and a charge. He can be suspended for more than five games, if the NHL does so choose.

Unlike Torres, Silfverberg is not expected to miss time as a result of the hit.

I believe it's been more than 18 months since Torres' last incident, so I'm not sure he's actually a repeat offender in the technical sense, but it's important to note Silfverberg isn't expected to miss time.

He's played 16 games over the last three years and missed the entirety of last season due to injury, then he comes back and does this? I guess he was making up for lost time.

He was suspended twice in late 2013:

They need to enact the Raffi rule then. Use 123 games rather than 18 months for repeat offenders.

I don't see why, IMO, 18 months should erase your history. If that's the precedent set by the league, that's pretty dumb to me.

I think the logic is that given the nature of the game and the difficulty in determining intent to injure, some standard needs to be applied. So if you go without committing an offense for 18 months, a pattern can't be used for showing intent. However, in a situation like this especially, the flaw is apparent. Someone can get suspended and then 20 games later that just happens to span more than 18 months commit another offense without being a repeat offender.

If you have a history of violence, dirty hits or whatever, even if it was years ago, it doesn't change the fact that you have a history of violence. People can change, but IMO not that many do. Matt Cooke's history wouldn't and shouldn't be forgotten if he headhunted another star, even though he hasn't done it in years. Neither should Torres'.

Maybe it's b/c it was pre-season and there weren't many other vets playing, is all I can think of.

In determining the length of suspensions, the CBA between the NHL and NHLPA states, “Players who repeatedly violate league playing rules will be more severely punished for each new violation.” Also he is not defined as a repeat offender, under the terms of the CBA, due to injury, Torres has only appeared in 15 games since his previous suspension for an illegal check to the head of Jarret Stoll. Torres has repeatedly violated league playing rules and has been sanctioned multiple times for similar infractions. In April of 2011, he was suspended for this elbow [video included] to the head of Jordan Eberle. In December of 2011, he was suspended for this charge against Nate [Last Name]. In April of 2012, he was suspended for a late, high hit to the head of Marian Hossa, which violated three NHL rules. In May of 2013, he was suspended for this illegal check to the head [on] Jarret Stoll. Torres has also been fined three times and warned twice for illegal hits. In short, in his 703 game NHL career, Torres has been warned, fined, or suspended on nine previous occasions. The majority of which have involved a hit to an opponent’s head.

Will his contract still count under Sharks cap? Or can they put him on LTIR and call up someone else? I know its not a big problem since he has a low salary, but it could really fuck up a team if it is a player with a higher salary.

His skating could keep him in the league a little while longer if he went the Cooke route and learned to be a defensive specialist, but I doubt it. Because I doubt he'll actually change his game the way Cooke did.

I'm also not sure you're gonna find a GM willing to risk an 82-game suspension on a player who will remain on the cap and counting against them as a contract either when he almost assuredly does this again.
